Freedom of speech is on trial right here right now. This isn't just about me, whether you like me or not... you are on trial too. Your right to FREEDOM OF SPEECH can be taken away from you within days. This isn't just about me. it may not make a difference to you whether we lose Lake Pirates or not, but it WILL effect your life from now on. If I lose... immediately all website communities will be subject to a similar lawsuit. Moderation on websites will be so stringent it won't even be worth your time to post. You won't be able to say "Lighthouse marina looks like shit" or "a salesman at a car dealership (pick one) lied to me." You won't be able to say "Obama is a socialist." You won't be able to say ANYTHING that ANYONE could construe as negative to their reputation or personal and business agenda.

As you know the entire basis of this site is FREEDOM OF SPEECH. I have always allowed anyone to say anything they want about me or any other company. Although I will defend myself voraciously, I do not stifle your right to speak.

This very REAL battle for my livlihood and possession of this site has already begun in the Tarrant County 48th District Court. It started yesterday (Wednesday January 20th) at 9:30 AM CST.

The plaintiff knows I am down on my luck financially and healt-hwise so struck at this time knowing I am unable to financially and physically put up much of a defense. I showed up in court with only my wife at my side to battle this despicable assault on my right to freedom of speech.

I am being sued for $500,000 cash plus the removal of all comments about the plaintiff. If I lose... you all lose. America loses.

The judge has given me a few days to get my act together which means I must get an attorney and mount a defense in a very short period of time.

I have applied for free legal aid which will take a lot of pressure off... if I get it? Even then, I will have to pay for all printing, expert witnesses, research, hotels, travel, digital forensics, transportation, parking (which is $20 a day!!!.. no shit), consultation, filing fees, serving fees and a host of other costs associated with this suit.

I need your help. Please give generously to the legal fund I have set up. I will post copies of the lawsuit and events of the case as they happen. To make it even worse... if I lose, the plaintiff could get control of this site. Do you really want someone controlling this site that isn't man enough to stand up to public criticism?

What the fuck is this about?

I would like to know more of the details, if you can give them. I have been on the road a lot the last 3 weeks so if I missed something my apologies for asking to repost.

I'll post the lawsuit as soon as I can get it scanned. Essentially Terry Wilson (an ex member) is suing us for $500,000 and possible control of the site because of my post I WILL NOT REMOVE about him in the Pimp a Business forum. You can read it there. I also put on his website that it was closed to due to non payment and he didn't like that either.

I went to court yesterday and found myself in WAY over my head. he has lot's of financial resources and i have just me. not even an attorney. However, if I lose. The site and every web community will be effected because it will set a legal precedent.

It's time to walk the walk. I hear many of you talk a lot about liberty and our rights. Now's your chance to back it up.

Before I post a few relevant pages from the suit here are the facts of the case:

Around early August Terry Wilson hired me to build him a website, set up server accounts, set up email accounts, obtain domains, pursue full time SEO, design all logos, graphics etc, design business cards, do mechanical drawings for building facade construction and all other related work on a full time basis. My original bid was $40,000. The day he came over to sign the contract he negotiated a $3,000 per month salary and a commission on ice machine sales instead of payment up front. I agreed and we decided we'd get together at a later date and sign new contracts but i would go ahead and begin. he gave me a first payment of $3,000 and we agreed he'd pay in the middle of the month each month thereafter.

I was very excited to have the project opportunity. I am very ill and this is about the only thing I can do from bed or in a prone position. I have had no luck in gainful employment since I cannot keep regular hours and am always on pain pills, muscle relaxers and Midrin among many others. I have tried all the online jobs you read about like "make calls from your home", "get paid to surf the web", "medical billing from your home" etc. They all turned out to be scams. I applied for disability but was turned down.

Since I was given this chance I intended to exceed every expectation he could probably have. Since I'm pretty good at the web i always under promise and over deliver because I know I can do it every time.

In the first thirty days I designed 22 different logos with over 1400 variations. I designed four different business cards. I desogned letterheads. I built two complete websites with original graphics. This all for a guy who had no idea what his company name was going to be, what his favorite colors were, or what fonts he even liked. With a client this loose, the possiblities are endless. it could take months just to design a logo.

During the design of all these things we maintained meticulous contact through email and phone texts. In all we wrote back in forth over 230 times via email alone. I saved every message. In this thirty day period I received nothing but praise for the unique work i had done and my dedication to the project. In the 40 day period in question, i put in over 400 hours. it's all i thought about day and night. Our email and phone texts show me working early in the morning until the wee hours of the night. Daya after day. Seven days a week.

When my first check was due he emailed me and said he had a problem transferring funds and it would be a couple more days. I had no problem with it. A couple days later he stalled me another couple days. (keep in mind i am still working the entire time). After that stall he agreed by text to meet me near my doctors office and give me a check. Once out of the doctor he texted me again and asked if I could meet him at a different location later in the day. I get to that location and he texts me again and says he was held up but would meet me at the house and bring me a check there. To say the least, I'm a bit worried at this point. Like anyone, I make promises based on income i have earned. If he didn't show up this time, i wasn't going to be able to keep my promises. I get to the house and he doesn't show. Instead, he emails me and says that I need to sign an I-9 or he wouldn't be able to pay me. I agreed and asked him to send me the I-9. he sent an unlegible document so i wrote him back and said i couldn't read it however, i had my own I-9's and could send him one of mine. Suddenly, after weeks of work, days of promise to pay.. he decided he didn't like the site and said i hadn't done enough work to earn the money.

This is where our relationship goes to hell. We argue back and forth write each other heated emails. it get's pretty ugly but then he says he was sorry for saying I didn't do my job well and that i had gone above the call of duty in the work i had done. he then says he has decided to break our agreement and that he decided he just couldn't afford $3,000 per month at this time. I think this is something he probably should have told me before i worked 400 hours but i am desperate for money so I say I'll give it over for my money. He says he wants me to sign over the domains, give him control of the website and email, send him all the artwork.. and then he'll write me a check. As you can guess, I wasn't in mood to trust him at this point. I say he needs to bring me cash and I will transfer everything at that point. he get's belligerant. i get belligerent. he tells me to keep the site because he doesn't need it anyway. Personally, I have no use whatsoever for an Ice machine website so i didn't consider this a very fair trade.

next recourse I take is replacing his home page with a message that said the site had been taken doen for nonpayment and used his name.

He decided to get another dba and just open up a new business without paying me. My only recourse was posting my experience here on lake Pirates and keeping his domain closed.

I may not be the easiest person to get along with but no one can ever say i didn't keep my word. They also cannot say i am dishonest because i am brutally honest. Even when it makes me look bad.

Terry Wilson then had his attorney send me a cease and desist. in that cease and desist there was this little quote, "Mr. Handley, I understand that you are not a well man and may be seeking disability status. I can assure you if this matter is not resolved immediately, the fact that you continue to work will be made a matter of public record if I am forced to file suit against you to enjoin your activities."

I consider this threat blackmail and I was turned down for disability over 30 days before I took the job with Terry Wilson. That quote enraged me to the point where i will not do anything but what is fair and that is $35 an hour for the time I worked less his original $3000 deposit. I'm not going to sue for a ridiculous amount but I will only accept what is fair. had I known I was only going to get $3,000 I would NEVER have produced the amount of work i did for him in such a short period of time.

Keep in mind i DO NOT make allegations. Everything I have said is verified through email or text correspondence with Mr Wilson.

Well, he decides to intimidate me and sues me for $500,000 because what i have posted on lake Pirates has hurt his stellar reputation and that (in his own words as quoted from the lawsuit) "Plaintiff was subject to public humiliation when referred to as a deadbeat and then associated with Defendants website which features lewd, lascivious, pornographic content featuring photographs of people engaged in activities which are contrary to Plaintiffs lifestyle and morals."

keep in mind i not only saved every email but Terry Wilson has been a paying member of this site since 2004. he used to be an administrator and he posted right up until this happened. he has almost 3,000 posts of which a good part are in Pirate party pics. As many of you know I DO NOT ALLOW PORNOGRAPHY on this website. I personally find it offensive. i don't even like gross pics.

Anyway, the lawsuit is too many pages to post but I will post the relevant pages. To show how unscrupulous he can be, Terry Wilson also sued my Wife.

I will be more than happy to delete all posts regarding Terry Wilson and the Texas ice factory. I'll be more than happy to turn over the domains, artwork and website. All he has to do is pay me. it's pretty simple.

His attorney just called and told me I was an idiot. he tried to throw my past in my face and said he would put me on trial for my past. I've never done anything bad (on purpose anyway) and am not ashamed of anything I've done EVER. I tell the truth, even when it hurts me. I am brutally honest and cannot be construed as a liar in real life, because i don't lie in real life.

I rarely lie on the internet. (I have a giant penis.)

I guess his attorneys don't understand that everything that their client did on Lake Pirates can be traced back to him. Like him paying for PP, posting pictures in PP. “Ring ring, ring ring… Hello, Hey pot, this is kettle, YOUR BLACK” What a bunch of dumb fucks. First of all I’m assuming you don’t have $500,000 because if you did you wouldn’t be worried about the money he fucked you out of and you wouldn’t be selling your stuff to make ends meet. Secondly he’s probably spent more than you were owed in legal fees. Good lawyers, dumb client. Send his lawyers a certified letter stating that as of X date, any and all phone conversations with them or Terry will be recorded. Then post them on here for all to hear.

This office has been retained by Mr. Terry Wilson to resolve, in whatever manner necessary, certain defamatory public statements you have published about him.

My understanding of the business relationship that you have with Mr. Wilson is that of an individual hired to create a web page for Mr. Wilson’s business, ******. The agreement included numerous responsibilities with which you were to comply. However, you have failed to comply in most, if not every, capacity.

Mr. Wilson agreed to pay you $3,000.00 for your services assuming he would have a fully-functioning web site in a timely manner. After a wait of more than one month, you raised numerous excuses for your delays and, after repeated inquires, Mr. Wilson learned that you misappropriated his domain name attempting to claim ownership in your own name.

Mr. Wilson refused your attempts at extractin g additional funds from him and asked to merely end the working relationship. Your response thus far has been illogical and illegal.

You have blocked Mr. Wilson’s access to his web site and have posted defamatory statements which have caused immediate and irreparable harm.

This is your only warning to CEASE AND DESIST from any further attempts to intercept Mr. Wilson’s emails and from having any contact with the web site ********.com. You must immediately remove any blocks to the web site, return all passwords and access codes to Mr. Wilson and remove all defamatory statements from the web site which include any statement(s) regarding any dispute you may feel exists as to monies you claim to be owed.

Mr. Handley, I understand that you are not a well man and may be seeking disability status. I can assure you if this matter is not resolved immediately, the fact that you continue to work will be made a matter of public record if I am forced to file suit against you to enjoin your activities.

I have little interest in your side of the story. So there is no need to respond. However, feel free to have your attorney contact me if you feel I have misstated any facts.

If you have not removed all derogatory and defamatory statements and returned complete access and control of the web site to Terry Wilson by 12:00 p.m. on Monday, September 28, 2009, I will file suit against you seeking injunctive relief, damages, costs of court and reasonable att orney’s fees.

LP in your earlier posts about this you said that you had a lawyer and were bringing suit against him, did you drop your suit or is this a continuation of that action? Or is he counter suing you? Not that it really matters either way, just curious?

The irony is that you should have sued him based on the facts. The email correspondence you saved alone is golden. Amazed that he didn't pay you even a reasonable % of what he owed you yet he can afford an attorney that can easily exceed what he owed you in the first place. Hold fast, I know it sucks right now, but you handled things on the up & up and once all is settled you'll be the bigger man standing.

I wasn't able to pay the retainer so opted to file a civil claim myself. We've been trying to serve him since October but he's changed business addresses and we couldn't find him. The judge asked his attorney to receive the suit on Wilson's behalf so I'm sending the civil suit to his attorney via a Collin County constable.

I think the Texas State Bar association would probobly like to know about this. All attorney's are required to swear an oath to support the U.S. Constitution and the Texas Constitution. If this is indeed a violation of your freedom of speech then he is violating your rights protected under the U.S. Constitution and furthermore is in violation of the oath he swore.

I'm not a lucky guy. I'll probably lose. I definitely can't get an attorney. Legal Aid is almost a joke. they're so backed up it's not even funny. I'll keep trying but more likely than not, I am on my own. Since this has already gone to court once with me reluctantly having to represent myself, lawyers are afraid of it. I've worn out my phone calling attorneys but I'll try up until the moment of the next court date and then I'll have to walk in alone, again. It's very intimidating and I doubt my blogging about it is helping me much. However, it's an honest debt. i did the honest work and I'll let a jury of my peers ruin my life if that's what's meant to be. What I won't do is be pushed around, bullied and taken advantage of just because I am without means.

I have already sold everything I own down to the towels. I'm virtually homeless. All I have left in the world is this site.. which he apparently either wants, or would enjoy being the guy who had it taken down. It's not only a fool who defends himself, it's also someone forced to defend themselves. What's the world come to when you can't even get legal aid? I kind of resent these attorneys who laugh about ruining lives because the system is so complicated you cannot win without means. This is a metaphor for our dump truck prison system. it's not a score card they use to measure the guilty. It's a scorecard they use to measure the indigent. It's bullshit but I will go down knowing I stood up for what was right and didn't compromise my integrity. This would all go away if I would just let him not pay me and I give him everything. I just can't do that no matter the consequences.

On the other hand, Terry can pay my invoice and and I will be happy to delete all posts and threads, turn over all art work, domains, (and other related materials), remove all seo regarding he or his business, and I'll never mention his name again on the internet. This has never been about revenge or hurting anyone. This is about getting paid on honest work.

This could be over in five minutes.

I'm shocked that there's not an attorney on LPF that wouldn't help you out. Come on guys this should be an open & shut case here.
